FINRA censured and fined Barclays Capital Inc. (CRD #19714, New York, New York) $500,000. Barclays consented to the sanctions and to the entry of findings that it failed to accurately disclose the percentage of covered companies for which it had provided investment banking services in the distribution of ratings sections of equity research reports. The findings stated that the firm failed to disclose in research reports that it was a market maker in the securities of the covered company at the time the research report was published. The findings also stated that the firm failed to adopt and implement adequate WSPs, in that it failed to require monitoring of the accuracy of the information captured in its disclosure database, failed to incorporate the use of exception reports to detect potential disclosure issues, and relied on manual reviews of research reports that were inadequate to detect disclosure issues.
